Payment

Before the actual photo shoot, the Photographer will provide the cost information of the chosen package to the Client. A retainer of 30% of the full package fee is payable when the photography agreement is signed, in order to book the date and time of your session. The Photographer will send the booking confirmation via email. The balance fee is payable by bank transfer to the Photographer’s bank account at least one day before the photo shoot or in cash on the day of the photo shoot.                                                              

Cancellation

Should you need to cancel your photo shoot, please ensure this is done, not less than 7 days prior to the shoot. Please understand that I will not book other sessions during this time once it is booked. Therefore the retainer of 30% shall be forfeited in case of late cancellation, but no further sum will be due. If the Photographer does not appear on the agreed location and time (specified in the booking confirmation), the retainer shall be refunded in full to the Client. In the event that the Client requests to reschedule the photo shoot, the Photographer should be notified at least 48hours in advance. The retainer shall be applied to the new booking date. The Photographer will offer a new date and time based on her availability. If both the Client and Photographer cannot agree on a new date within the same calendar year, the retainer cannot be refunded.

Late Arrivals

Please try to arrive on time for your session. Unfortunately, in the case of late arrivals the time will be deducted from your session. Please plan enough time for traffic etc. and do please let me know if you are running a little late.

Copy rights / social media

The copyright of all images will remain with the Photographer - this is standard practice, and the Photographer will have the exclusive right to make reproductions for, including but not limited to, marketing materials, website and or studio display. The images may be use on Photographers Facebook and Instagram page for displaying the portfolio. Clients can display the images on their private social media pages for private (non-commercial) use only.

If the Client does not wish the images to be displayed on the Photographers social media accounts or on the website, kindly inform her in writing.

Failure to perform

If the Photographer is unable to perform this agreement due to illness or emergency, due to causes beyond her control, she will make every attempt to reschedule the session.

Material Damage

In case of any technological malfunction, included but not limited to camera and processing, the money shall be returned to the Client or a new session will be booked.

Complaints

The Photographer will at all times use best efforts to deliver a product that will do justice to your requirements. Owing to the nature of the picture report however, no guarantee can be given in respect of producing specific pictures. Should you have any complaints, these should be submitted in writing to the Photographer as soon as possible, and in any event within ten days from the date of delivery. Refunds will only be made in the event of clearly damaged photographs due to technical malfunction.

Legal Fees

If either of us brings a legal action against the other to secure the specific performance of our agreement, collect damages for breach of this agreement, or otherwise attempts to enforce this agreement, the successful party shall be entitled to recover reasonable attorney’s fees and all costs, premiums for bonds, fees and other expenses expended or incurred in the action in addition to any other relief that may be awarded.
